Number one rule...NEVER go to a paralegal. We have so many clients that come to retain us because in one way or another a paralegal has screwed them over. Especially a certin paralegal, but i can't name his/her name on el foro. And also a paralegal has certain limitations as to what a lawyer can do. You may end up paying more then a paralegal, but at least you know they will do the right job, but of course you need a good Immigration Lawyer. If you go to the website i've given you, you will know that the Law Firm is a well respected and known for their services. Trust me, when they need an input from an immigration Lawyer the Media always goes to this firm.
Question...
1. Does el cubano want to stay here in Canada? He can apply as a Skilled Worker. But he has to fill out a Self-Assessment to see if he has enough points to qualify.
2. If he wants to stay here, they should get married and then she can sponsor him. Since they haven't lived here for one year, then they do not qualify for a Common-law sponsorship application. She can do an Inland sponsorship application, but depending on their situation/status they might be better off with a Overseas sponsorship application.
But you need to speak to a specialized Immigration Lawyer.

And just today I received a message asking for help about... well, you guessed it right, an immigration case. I am sorry for having returned to ask favours around but this message came as something urgent. the thing is... a cuban guy who presently lives in costa rica.... his gf is from costa rica but presently lives and works in toronto. They want to get together here, the gf has her papers in order soooo.... what would the cuban have to do in order to move to canada and establish here with his gf? makes sense?
you need to file a family class application as soon as possible ... also it would help if they were already or if they had plans to get married in the very near future.
If you dont want to spend the money on an immigration lawyer (which could potentially run you a tab of up to 5 grand) you could go with an immigration paralegal... they are authorized the same as a lawyer is in these matters and would charge you half the amount. However if money is really tight, there are hispanic centers that could fill the paper work out for you. You would only be required to pay for the government application fees.
One thing that you really should take into consideration when thinking of applying is that the new system that has been implemented makes it extremely difficult to gain residency. There is new points system in place wherein Canada favours the most educated of the educated.
So it might be wise to asses what your chances are prior to starting the long and costly process.
What type of papers does the gf have? Is she a Canadian Citizen or Perm. Resident? Have u checked the Government site? All the info is there
If you get a lawyer make sure they specialize in immigration otherwise your friend can just follow the procedures outlined in the website herself and they should be ok.
