No HR departmentIt explains everything. Probably you can teach something to the wise ladyGo to the website or call to the ministry of labour, they give you info about how to fill a complaint.I think you should talk first with that woman, it is kind of difficult because it seems like you are new employee, and the company is not going to be happy with " empleados revoltosos" , but just approach her and mention that you have some concerns or doubts. It is something wrong there, and you will be more satisfied with clear answers.

Obvioulys that you company is doing something wrong. It bothers me a lot, people are violated in their rights because lack of information. I took the info below from the ESA


Employment Standards Act

Employment standards are enforced under the Employment Standards Act, 2000 (ESA) which sets out the minimum standards that employers and employees must follow.


Most employers and employees in Ontario are covered by this provincial law. The ESA does not apply to you if you operate or work in a business that is regulated by the Government of Canada, such as: airlines, banks, shipping companies, radio and television stations, inter-provincial transport of goods and people.


Victoria Day A Public Holiday Under the Employment Standards Act, 2000

TORONTO—Many workers will get a day off with "public holiday pay" on Victoria Day, Monday, May 20, 2002. Victoria Day is one of eight public holidays under Ontario's Employment Standards Act, 2000 (ESA)


Qualifying For Victoria Day Entitlements

Generally, employees qualify for Victoria Day entitlements unless they fail, without reasonable cause, to work:



  • their entire regularly-scheduled shift before or after Victoria Day; or
  • their entire shift on Victoria Day if they agreed or were required to work that day.

Public holiday pay is an amount equal to an employee's regular wages earned in the four work weeks prior to Victoria Day plus any vacation pay payable during that period divided by 20.


“ Employees who qualify for Victoria Day entitlements can be full-time, part-time, permanent or on a limited-term contract. They can also be students. It doesn't matter how recently they were hired or how many days they worked before Victoria Day.”


Entitlements if Victoria Day is a working day

Qualified employees are entitled to take Victoria Day off with public holiday pay. They can also agree in writing to work on Victoria Day and:



  • be paid their regular rate for all hours worked on Victoria Day plus receive a substitute holiday with public holiday pay; or
  • be paid public holiday pay plus "premium pay" of one-and-a-half times their regular rate for all hours worked on Victoria Day.

Entitlements if Victoria Day is a non-working day

If Victoria Day falls on a non-working or vacation day, qualified employees can either take a substitute work day off with public holiday pay or, if they agree in writing, they can receive public holiday pay for Victoria Day with no substitute day off.


Entitlements For Non-Qualified Employees

Generally, employees who don't qualify for public holiday entitlements must work on Victoria Day if asked by their employer. Most non-qualified employees are entitled to be paid one-and-a-half times their regular rate of pay for each hour worked on Victoria Day. There is no substitute day off.


If a non-qualified employee is not asked to work on Victoria Day, he or she gets the day off with no pay.


Special Rules / Exceptions
Retail Employees

Most employees who work for "retail businesses"—businesses that sell goods or services to the public—have the right to refuse to work on Victoria Day even if they don't qualify for public holiday entitlements.


Retail employees who have agreed to work on Victoria Day may still refuse the assignment if they give their employer 48 hours advance notice before the first hour of work on Victoria Day.


Well other people have the information and they are afraid to use it, and it is an another history.Anway, for sure your company is doing something wrong and unfair.

no angency for me bro.. but all i know is that u must work a min of four hour to get your holiday pay if the holiday in on friday u must work a min of four hors on thursday, and on monday to get your pay

Loco are you in an agency?  If so your fortunate but there are SOME (at least thought all of them were like that) but I know some that pay with a minimum # of hrs before your valid and getting those days paid for.

CALL AND ASK THE LABOUR BOARD! AND IF THEY HAVE HUMAN RESOURCES SHE CAN ASK THAT PERSON BUT IT IS NOW BASED ON HOURS WORKED!!


REASON BEING U CAN START TODAY AND TOMMORROW IT BE A HOLDIAY UR NOT ENTITLED TO PAY! SORRY


ALSO IF ITS CONTRACT!! MANY IFS AND BUTS!!!

Here at my work....I got a pay raise 2 yrs after I started...I had to ask for it...and I had to also fight for it as I wanted a certain amount and they wouldnt give it to me so I had to settle for middle...


and this past January was my first vacation in 3 years working here....I hate this place they truly treat you like crap and you work you ass off! Its truly sad....

Well, to get you actual vacations time, yes, altought I had them prorated straight ahead (I started end of July'05 and I had like 5 or 6 days) so I had already few days in my bank but in terms of national holidays (las de ley) the one paid but not worked, I always had them paid regardless of the 3 months period.

yup.. i think is in all business... all depends who u work for.. sometimes u get lucky... and u get paid no matter how long u have work there!!!

I know. It seems really unfair. When I first started working here, I was under contract, so I didn't get benefits and no paid holidays and crap like that. Then they hired me full time and for a year (YES, THAT'S RIGHT, A YEAR) I didn't get any vacation. Now that I've been here long enough, I'm taking full advantage...

I guess  you`re not getting paid for the holidays cause you havent been there 3+ months.  I know, it sucks, welcome to corporate Canada
