if you go to court the police report will be a big desicion maker for the judge, also because there are no witneses, but if the police didnt charge him or your brother so whos fault is it this must be up to interpretention, so the truck driver could blame your brother and you will blame it on him, and this situation may not be good to you and it may cost you more if you get a lawyer and lose.
The only other person that you can call to court is the actual police oficer that wrote the report.

ricky try contacting the trucking company they may be willing to pay for the damages directly without it going through insurance companies, an rates going up for no reason, if not your next step is to use a lawyer but this will not gain you anything because no collision ( no pay ) .

MY BROTHER HAD A CAR ACCIDENT. HE GOT HIT ON THE SIDE BY A 18 WHEEL TRUCK, HIM (MY BROHTER) DOES NOT HAVE COLLISION AND HIS CAR INSURANCE IS NOT BEING VERY HELPFUL CAUSE OF NOT HAVING COLLISION. SOMEONE HAS SUGGESTED TO TAKE THE DRIVER OF THE TRUCK TO COURT FOR THE DAMAGES. THERE IS A POLICE REPORT BUT NO CHARGES LAID. IT WAS THE TRUCK DRIVER FAULT.
