Apparently no. So he can just come back on day 31 and be ok. But I am sure that ifyou can proove that it was made on purpose, he can still be served.

This case is so ****ed up!! Seriously now, what kind of poor excuse of a judge would rule this case as Sexsomnia?! A doctor (sleep expert) said it was brought on, by alcohol, sleep deprivation and genetics. The accused has now said that he has cut down on his drinking and is taking pills to stop a repeat of his crime.....So this is supposed to be ok with us??? This might be a form of an excuse, for the next person accused in a sex assult!! By the looks of this judge, the next person might get off as well!!! What is wrong with the legel system?!?!? I can tell you from experience in the legal field, that there are many judges out there who sometimes don't do their job right!!
I read about it as well. And WTF was this judge thinking about , maybe he was thinking about how to get some "fun", on someboby's else expense, without getting caught.
The scariest thing is that as you mentioned Angelita, is that know, there is "un antecedente" which will allow the next crime offenders to have an easy way out, what a shame.
I hope that the victim(s) will try to have this ruling teared down (is it the correct way to say it, sorry) by a higher instance, like the Supreme Court, if an appeal does not work.
