Apparently no. So he can just come back on day 31 and be ok. But I am sure that ifyou can proove that it was made on purpose, he can still be served.

Are women too "OPEN" to hooking up with people?  I've been out of the dating scene for more than 8 years now and it just seems to me that nowadays ppl are more open to the idea of casual sex.  I realize that this situation was not consensual but at the same time why were they back at his/her place in the first place... just something to think about...

I hope that the victim(s) will try to have this ruling teared down (is it the correct way to say it, sorry) by a higher instance, like the Supreme Court, if an appeal does not work.

A doctor (sleep expert) said it was brought on, by alcohol, sleep deprivation and genetics.


The accused has now said that he has cut down on his drinking and is taking pills to stop a repeat of his crime.....So this is supposed to be ok with us???


This might be a form of an excuse, for the next person accused in a sex assult!! By the looks of this judge, the next person might get off as well!!!


What is wrong with the legel system?!?!?


I can tell you from experience in the legal field, that there are many judges out there who sometimes don't do their job right!!

It's funny that this comes up.  yesterday on Dr. Phil , it was about people being tricked into having kids... :blah: long story... anywhoo.. there was this one couple that the husband would have sex with her while she slept to get her pregnant.  She never knew they were having sex until the next morning when she was kind of left wondering...


I think sleep sex is common amongst married ppl... you wake up in the middle of the night, have sex and go back to sleep... but this ruling itself is complete and total bullsHIAT...
